Equipment Use & Rental Agreement

Delivery, Use, Care, Replacement Services, Right of Entry

By signing this application, you agree that any equipment delivered and installed at your service address, as listed in our business records, is for personal use at that location. You agree not to remove the equipment from the address except to return it to WRT. You also agree to take reasonable care of the equipment and not to open, disassemble, or alter it in any way (except to change batteries in the remote control). You are responsible for any damage to the equipment beyond normal wear and tear that occurs prior to its return. Equipment must be returned in fully functional condition. If you notify WRT of equipment failure not caused by misuse or abuse, we will repair or replace it with properly functioning equipment. You agree to allow WRT personnel access to your service address at any reasonable time to inspect, repair, replace, or remove the equipment as needed.

Payment for Use of Service and Failure to Comply with Agreement

Your use of WRT-provided equipment and services is subject to WRT’s policies and procedures, which may change from time to time. Monthly fees for equipment rental are billed in advance. If you do not comply with the terms of this agreement or the terms under which you receive services, you agree that WRT may, individually or in combination: 1) terminate your right to use the equipment; 2) terminate your services; 3) recover the equipment; and/or 4) pursue legal or other action to recover the equipment and any unpaid balances, including liquidated damages for failure to return equipment as outlined in this agreement.

If You Choose to Stop Using the Equipment

You may terminate your use of the equipment by contacting WRT Customer Service. Upon termination—whether initiated by you or by WRT—we will request that all equipment be returned. At that time, all rental payments and any additional charges will be due. You agree to make arrangements for the prompt return of the equipment. EQUIPMENT NOT RETURNED UPON DISCONNECT IS BILLABLE.

Liquidated Damages for Failure to Return Equipment

If you fail to return the equipment in a timely manner, you agree that the damages incurred by WRT are not easily calculated and may be significant. As a result, you accept that a reasonable estimate of these damages is the replacement cost of the equipment and power cords, plus any expenses associated with WRT’s efforts to recover the equipment. Your cooperation in promptly returning any WRT equipment is appreciated.

WRT offers one residential gateway for lease as part of the package. Residential gateways, power supplies, and cords remain the property of WRT, and in some cases, may need to be returned when service is disconnected. Equipment that is not returned within five (5) days after disconnection will be billed to the customer at reasonable retail rates.

WRT provides this service for the purpose of direct access to the Internet. This is not a wholesale service and may not be resold by the customer. Please review WRT’s Acceptable Use Policy, which is available in the Legal Notices section of our website at www.westriv.com. Violation of the policy may result in termination of service.

I have read and understand the above information and authorize WRT to install high-speed internet service. I am at least 18 years of age, and the name on the account where the service will be installed matches the name above. This agreement is nontransferable.
